Die Klägerin muss sich nur die Regeln des ECC und allgemein übliche Usancen des internationalen Kaffeehandels zu ihren Lasten entgegenhalten lassen. Art. 27 ECC 2002 sieht in der ab 1. September 2007 geltenden Fassung sehr flexible Formen der Geschäftsdokumentation vor. Insbesondere zeigt Absatz b dieser Vorschrift, dass im Zweifel die Angemessenheit und Wirksamkeit von Kommunikationsmethoden durch das Schiedsgericht im Einzelfall zu beurteilen ist. Die Verwendung des AOL Instant Messenger Systems ist im internationalen Kaffeehandel üblich und gilt als zuverlässig. Gleiches gilt für die Kommunikation per E-Mail.

Article 27 ECC – Notices

(a) Notices to be given under the contract shall be given only by one or more of the following methods:

(i) Facsimile

(ii) E-mail,

(iii) eCops,

(iv) any other method of written electronic communication provides that record of the notice is capable of being preserved by both parties and printed by both parties and that such method of communication has been expressly agreed in writing.

(b) If there is a dispute as to whether or not a notice was given in accordance with this Article 27 such dispute shall be determined in all the circumstances of the case and on the balance of probabilities.
